1. Ordering goods from us online
When you place an order with us, you are making an offer to buy goods. An order is placed on our website via adding a product to the shopping cart and proceeding through our checkout process. The checkout process includes giving us delivery and any other relevant details for your order, entering payment information and submitting your order.
We reserve the right to limit the number of an item customers can purchase in a single transaction. We will send you an e-mail to confirm that we have received and accepted your order, which indicates that your order has been accepted and you may not cancel it. You may print out this e-mail as a receipt of your order.
2. Refusing or cancelling orders
In the unlikely event that the goods ordered are no longer available we reserve the right to refuse or cancel an order.
We reserve the right to refuse or cancel any orders that we believe, solely by our own judgement, to have been placed fraudulently. We also reserve the right to refuse or cancel any order that cannot be delivered for any reason.
While we endeavour to ensure that the price and description of goods or services is accurate, if there is an error in the process of listing a product or service on our website or a technical error in the processing of your order we reserve the right to refuse or cancel the order.
Our right to cancel orders applies to orders that have been accepted.
We currently accept payment via internet banking and secure credit card payment via Paymate.
Goods will not be shipped before payment has been received, unless agreed in writing. Credit card payments are marked as paid immediately. Online transfers can take time to clear, and are subject to your bank's terms and conditions.
All prices listed on www.growurban.nz are in New Zealand dollars and are inclusive of GST. Please note that we reserve the right to alter prices on our website at any time for any reason.
5. Website and Credit Card Security
Your email address will go onto our e-newsletter database from which you may unsubscribe at any time. We do not pass customer details on to any third party except as required by law.
At this time, we only deliver to New Zealand addresses. We require a physical delivery address. We cannot deliver to Post Office boxes.
Please note that a signature is required for all deliveries. The goods become the recipient’s property and responsibility once they have been signed for at the time of delivery. Do not sign for goods that appear to be damaged. If damage is found after signing for the goods, please contact us within 48 hours at email@example.com. We will use this information to make a claim against our courier company. We will offer you the choice of a replacement or a full refund, once we have received confirmation from our courier company that delivery was not successful. To ensure successful delivery, please provide a delivery address where someone will be present during business hours to sign for the receipt of your package.
Once payment has been received, we normally ship the product within two working days (note that this is subject to the availability of stock and does not apply to refills. Refills, and products containing Refills, are shipped once per week on Wednesdays). Standard Fastway courier times apply. If you have not received the goods within 5 working days of shipment, please contact us.
8. Warranty information
All goods (excluding plants) are covered by a 12-month warranty covering materials and workmanship. In the process of determining whether an issue is covered by warranty we may, at our discretion, request photographs, arrange a viewing time agreeable to both parties, or have the goods shipped to us at our expense.
If we decide an issue is covered by warranty we will, at our discretion, repair, replace, or refund the total cost of the goods and shipping. Our liability is limited to the total cost of the goods and shipping supplied.
Plants that arrive in a damaged condition will always be covered by warranty as long as the damage is noted on the courier receipt and we are advised immediately. If possible, a photo of the packaging and plants should be taken on arrival.
Issues with plants after arrival will be dealt with on a case-by-case basis but the instructions provided on how to care for them from their arrival must have been followed.
If we decide an issue with the plants supplied is covered by warranty we will, at our discretion, replace or refund the cost of a refill pack and the associated shipping. Our liability is limited to the total cost of the refill and shipping supplied.
9. Exchanges and refunds
Returns (other than warranty returns) are only accepted by prior arrangement, and must arrive in a saleable condition within 7 days of delivery. All shipping is non-refundable and a 15% administration fee will apply to all returns.
NB: This returns policy does not apply to plants. All plant purchases are non-refundable and will be charged at the standard price of a one-off refill.
If any part of these terms is deemed unenforceable by a court of New Zealand, the intent of the part shall be enforced as permitted by law. The rest of these terms will remain in full force.
11. Change of terms
GrowUrban Limited reserves the right to change these terms and conditions at any time without notice.
